General contractual principles - construction and interpretation of contracts
The Court of Appeal of the Supreme Court of Queensland has confirmed that, where contractually construction must be completed within a specified timeframe, coupled with a condition precedent for performance, the courts will imply an obligation to do whatever is reasonably necessary to achieve performance of the contract. [Case ref: Williamson & McGillivray & Ors v JIA Holdings & Anor [2011] QCA 346.]
